For years, BELLISSIMO LAW GROUP PC has offered our corporate clients the benefit of a legal opinion service. Many of our corporate clients approach us to render legal opinions in advance of the transfer of foreign workers to ensure all immigration issues are sorted in advance and not when they need a foreign worker urgently. So in the past few years, we began offering this service to individual clients with great results. With over sixty possible immigration categories, potential medical and/or other admissibility issues, clients want peace of mind in advance of embarking upon the immigration process for issues that could not be fully addressed in a consultation. With the new compliance regime introduced a few years ago by Employment and Social Development Canada, the complexity, scope and potential consequences for both employers and workers have transformed.
Not all perceived legal problems might really be an immigration legal problem! Not all legal problems may require the assistance of a lawyer. Yet, clients could not enjoy peace of mind without fully canvassing the issues. So do not fall into the trap of relying on what you may hear in the media or what a friend who “has been through it” tells you to do. It may be nothing or it could be very serious that has time limitations requiring immediate action.
Canada is commonly recognized throughout the world as one of the most desirable countries to live in. Thus, the flow of immigrants to Canada is especially strong. The Government of Canada responds to this flow with and is guided by, the creation of policy objectives. These objectives include demographic goals in Canadian population, efforts to enrich the cultural and ethnic fabric of Canada with a view to its bilingual nature, family reunification and the need to uphold international legal obligations with respect to refugees, to list a few. Currently, the heavy emphasis has been placed on economic migration, which will continue in the foreseeable future as the new Express Entry model becomes a core component of immigration delivery.
Key objectives to keep in mind:
- The purpose of the Immigration and Refugee Protection Act is to permit immigration, not prevent its flow
- The policy directives must be interpreted in positive terms
- Applicants have the right to frame their application in a way that maximizes their chances for entry
- The administration of immigration must be consistent with its objectives
- Immigration officers must provide a thorough and fair assessment of applicants and provide adequate reasons for refusals when they occur
