We are most pleased to report that an entire family’s inadmissibility has been removed today following a Rehabilitation application. The Rehabilitation application originally dates back to many years ago, that was refused. The refusal was challenged to the Federal Court, and we were successful in identifying that the refusal was made in error and the Federal Court application was settled. The Rehabilitation application was sent back for reconsideration, wherein updated and detailed arguments were made on the family’s behalf; leading to the approval!

This Week’s Success Story: A Successful Outcome Achieved For A Spousal Sponsorship Appeal

We were recently successful at challenging a Spousal Sponsorship refusal alleging that the marriage was not genuine and that it was entered into primarily for immigration purposes. The Applicant had lived in the United States without status for nearly a decade and immigration Canada suspected his motivation for marriage was to acquire permanent resident status in Canada. In challenging the legal validity of the decision, we provided comprehensive evidence documenting the genuine nature of the relationship. We also dedicated adequate resources to witness preparation which in conjunction with the documentary evidence persuaded the IAD that the marriage was genuine.

This Week’s Success Story: Parental Sponsorship Application Approved Despite Medical Inadmissibility Finding

We worked on and recently had a successful conclusion of a parental sponsorship application that had taken nearly 10 years. The matter was under review for medical admissibility for renal failure – End Stage Renal Disease. Following careful medical evidence review, medical research and consultation with professionals, we discovered that the information relied by the Department in concluding that the Applicant would cause an excessive demand in Canada was incorrect. We submitted the correct information, carefully set out the need for dialysis or a transplant to be remote given the Applicant’s particular circumstances, and applied the Kidney Failure Risk equation. Following all of this, the application was approved, and we are pleased to inform that the family will be reunited in Canada after waiting nearly a decade.

This Week’s Success Story: Work Permit Extension Approved!

Our office assisted a client with work permit extension application. We submitted the Bridging open work permit application based on her pending permanent residence application under the Express Entry. We worked diligently to complete and submit our client’s work permit extension application. Our submissions were accepted and her application was approved in two months.

This Week’s Success Story: Challenging Study Permit Approved!

We just received an approval of a study permit. This was a challenging application, as the client previously applied on his own twice and both times he was refused. We undertook an extensive review of our client’s history, conducted in depth meetings and prepared detailed submissions as well as collected extensive evidence and then linked the submissions to the evidence in a concise and thorough manner. It was a lot of hard work but overcoming two previous study permit refusals requires careful preparation. Our client is thrilled and we are happy to be have been of assistance that made a difference.
