										<content:encoded><![CDATA[<p>We have been retained by a client who has been working under an International Experience Canada (IEC) class for more than half a year in Ontario. The client was from a French-speaking country, having also a high level of English knowledge (speaking and writing). A company from Ontario who has business in many countries, including French-speaking ones, was very much interested in retaining the services of this individual. They interviewed the foreign worker and were very pleased with his knowledge and level of experience. The company decided to extend a job offer to the applicant. Being a francophone working in Ontario (outside Quebec), the process of obtaining the work permit for the foreign worker exempts the company to obtain a positive Labour Market Impact Assessment (LMIA) prior to submitting the work permit application.</p>
<p>The foreign worker decided to submit the application on his own. Much to his surprise, he received, after a couple of weeks, a refusal to his application. The applicant came to us to ask for advice. We checked thoroughly the application he submitted and realized he missed some important documents to attach to his application, therefore the work permit application could not have been approved as it was submitted.</p>
<p>The foreign worker retained our services and we prepared a restoration of the LMIA-exempt work permit, for a Francophone working outside Quebec. The applicant realized how thorough we were and how many supporting documents we wanted to provide to IRCC, to have a perfect image of the situation. We submitted the application and after a couple of months, the restoration of the work permit was approved and the work permit for a period of two years was issued. 										<content:encoded><![CDATA[<p>We are pleased to share with you our most recent success story which made headlines across Canada. Our team is extremely proud of the work of Mr. Chris Collette and members of our litigation team that worked to successfully defend Dr. Irfan Saddique’s Grant of Citizenship.</p>
<p>Mr. Saddique, an immigrant doctor doing medical training in the United States, applied to become a Canadian citizen; declaring having only 177 days of the 1095 days of residence in Canada required to gain citizenship. After interviewing with a citizenship judge, Mr. Saddique’s application was approved, however the decision was subsequently appealed by the Minister of Citizenship and Immigration to Federal Court, who argued that the evidence he provided about his ties to Canada was inadequate.</p>
<p>Thanks to the expertise and months of tireless effort of Mr. Collette and the Bellissimo Law Group team, Madam Justice Elliott confirmed that the citizenship judge’s decision was legally correct and that the conclusion that Mr. Saddique had centralized his mode of living in Canada was reasonable. Several factors were considered, including that he had tried extensively for a medical position in Canada, maintained strong family ties in this country, and returned to be with his family whenever he could. Madam Justice Susan Elliot found no reason to disturb the earlier decision to allow Mr. Saddique to become a Canadian!</p>

<p>A couple, both out of status for several years in Canada, approached us for assistance with their options for permanent residence.  Our office assisted the couple to submit applications under the Humanitarian and Compassionate Grounds (H&amp;C) category.  We prepared strong submissions highlighting the disproportionate hardship the couple would face if they returned to their respective birth countries.  Additionally, that it was in the best interest of their Canadian born children for the couple to remain in Canada.</p>
<p>Just over three months after submission, we received first stage approval on the couple’s H&amp;C application.  Our clients have since completed their medical and criminal checks and have now received their permanent residence confirmation dates.</p>

<p>A child became critically ill while visiting Canada with her parents. Upon seeking medical care, efforts were made by Canadian doctors to transfer her back to her home country for continued care. During these investigations, the family learned that the child would not receive necessary medical care in her country and would not survive. Not knowing what else to do, the family asked for Canada’s protection.</p>
<p>We were able to establish that her home country regularly provides medical care to people with her condition – so long as they are adults. Medical care is not provided to children with her condition because the doctors and medical system in her country are not able to provide the support required to children. The Refugee Protection Division accepted our argument, that her home country was able to provide the required medical care but chose not to provide this care to children, discriminating against children on the basis of their age. This child and her parents have been granted protection in Canada, where the child is already under the required pediatric care.</p>

Their findings were incorrect, and only after a difficult battle and the presentation of two separate Mitigation Plans providing evidence that no excessive demand would result in Canada, the family will finally be reunited in Canada after 7 long years.</p>

<p>In 2009 we were retained to assist a young man with his refugee claim. He was in an interfaith marriage, and feared that he would be returned to his home country. The Canada Border Services Agency (CBSA) was involved in the refugee hearing, as there were also security concerns. In 2011, following interviews with the CBSA and the Canadian Security Intelligence Service, he was granted status as a Convention Refugee. Now safe from being returned to his country, the assessment of permanent residence began.</p>
<p>While on a road trip with friends in Canada, this refugee was arrested for theft together with his friends in 2012. While waiting in the car, a friend stole some items from a store in another province. We updated Citizenship and Immigration Canada (CIC), and advised that these charges would delay his permanent residence. A criminal lawyer was required, and in 2013 the criminal charges were withdrawn. We again updated CIC and waited for his application to be processed. By the end of 2014, there was no progress. We commenced an application for mandamus – demanding that CIC process his application for permanent residence – with the Federal Court of Canada in 2015. We filed arguments demonstrating that, even with the delay in processing caused by the criminal charges, CIC was taking too long. Before the Court proceedings were concluded, our client was invited to become a permanent resident of Canada.</p>

<p>Our office was approached by a young professional to manage his permanent residence application under the Express Entry system. He had extensive work and travel history.  He also held complicated financial records, which were required to prove his ability to become financially settled in Canada. We worked diligently to complete and submit his permanent residence application pursuant to the Express Entry category – Federal Skilled Worker Program within a one month period.  His application was therefore submitted well within the 60 day deadline provided to our client by Citizenship and Immigration Canada.</p>
<p>Only four months after submission, we received a request for original passport for CIC to place his permanent resident visa inside. His original passport will be submitted to CIC and we expect our client to become landed in the near future.</p>
