Bill C-43, also known as the Faster Removal of Foreign Criminals Act focuses on the inadmissibility provisions of the Immigration and Refugee Protection Act. Currently, permanent residents who are sentenced to a period of incarceration of 2 years or more lose their appeal rights to the Immigration Appeal Division (“IAD”). With Bill C-43, permanent residents who are sentenced to 6 or more months of incarceration will lose their appeal rights to the IAD. Therefore, with the passage of Bill C-43, more permanent residents will be unable to appeal to the IAD and would be removable from Canada.
