										<content:encoded><![CDATA[<p>As we all know, there are many foreign students who graduate from a college or university in Canada. They are then eligible for a post-graduate work permit (PGWP) and many of them find a job related to their skills and education.</p>
<p>But there are also many who cannot find a job according to their level of education. It is very frustrating, as these individuals invested time and funds to further their education in Canada and try to integrate into the Canadian society, by being productive and responsible foreign workers. We meet many such individuals who, being close to the end of their 3-year post-graduate work permit, still did not find a qualifying position to apply under the Canadian Experience program. It is frustrating for everybody, for the foreign worker and for their parents, who hope that their son or daughter will have a better life in Canada. One piece of advice we can give to all the foreign students who graduated in Canada and obtained a post-graduate work permit – please seek advice from the beginning, do not wait until the last minute to check whether the position you worked for is eligible under the National Occupational Classification list (NOC) for the CEC program.</p>
<p>We have had a case where the client contacted us early, after one year working on a position that he believed was eligible for the CEC program. When we told him the position was in fact at NOC level C, he was shocked. We advised him to look immediately for a new position and explained the NOC matrix to him. He followed our advice and then we helped him with his CEC application under the Express Entry. We were successful and you cannot describe his gratitude for the help during all this long process.</p>

										<content:encoded><![CDATA[<p>On 25 October 2016, Statistics Canada announced about The National Occupational Classification (NOC) 2016. NOC 2016 is jointly released by Statistics Canada and Employment and Social Development Canada (ESDC). NOC 2016 is an update to NOC 2011.</p>
<p>NOC is the authoritative resource on occupational information in Canada.  The main purpose of NOC is to help people to understand the jobs found throughout Canada&#8217;s labour market. The NOC system categorizes the entire range of occupational activity in Canada.</p>
<p>Detailed occupations are identified and grouped primarily according to the work performed, as determined by the tasks, duties and responsibilities of the occupation. NOC 2016 updated the description and job duties of some unit groups to reflect changes in terminology and correspond with current usage and the evolution of some occupations.</p>

										<content:encoded><![CDATA[<p style="color: #000000; text-align: justify;" align="justify">Effective 1 April 2015, as a general rule, many foreign workers who have worked in Canada for 4 years will be unable to renew their work permits until another 4 years pass. This is known as the &#8220;4-in, 4-out rule&#8221; and was passed by cabinet in 2011.</p>
<p style="text-align: justify;">There are some specific exceptions to this rule. Work permits for occupations under certain National Occupational Classification codes (A or O) and work permits granted under international agreements (such as the North American Free Trade Agreement) can be exempt. Also eligible for exemption are specific types of work permits, including intercompany transferee, bridging, PNP and certain spousal work permits. Further, in certain cases, extensions of time might be also be possible. The exceptions are, however, strict and narrowly tailored.</p>
<p style="text-align: justify;">On a policy level, the 4-in, 4-out rule has been criticized because it can create a class of illegal immigrants overnight, which might have negative effects on the labour market in addition to high enforcement costs. This rule can also have significant implications for employers who must find new labour for the same positions leading to inefficiency. Moreover, it can lead to implications for individuals who may need to depart the country irrespective of the ties they have formed in Canada or the contribution they make to the Canadian economy.</p>
<p style="text-align: justify;">In light of this new rule, if staying in Canada is important to a person, it is ever more important for eligible individuals to apply for permanent residence in a timely manner once they become eligible.</p>
