After being refused three times for previous Labour Market Impact Assessment (LMIA) application, we were successful in securing a LMIA for an employer in need of a caregiver for his two young children. A comprehensive submission letter was submitted with extensive documentation to alleviate the concerns outlined by the visa officers in his three previous refusal letters. Furthermore, we worked with the employer to provide new advertisements adhering to the recruitment requirements. We are pleased that we were able to quickly facilitate the employer’s ability to hire a temporary foreign worker as a caregiver for his children in Canada.

The post This Week’s Success Story: Employer Receives LMIA After Three Refusals! first appeared on Bellissimo Law Group.

The Government of Alberta recently announced that beginning January 2, 2018 all its economic class under the Alberta Provincial Nominee categories will be updated. In accordance with the announcement made by the Alberta Provincial Immigration Nominee Program, the only available category for applicants will be “Alberta Opportunity Stream” which excludes self-employed farmers. Further, in 2018, the AINP will be implementing intake and nomination guidelines that will establish the maximum number of applications accepted and nominations issued each year by the province, as well as maximum number of applications and nominations by sector and occupation.

Additionally, the AINP will implement a list of ineligible occupations.

Beginning 2018, in accordance with the new residency status and work permit requirements criteria, an applicant must have valid temporary resident status in Canada that authorizes that individual to work in Canada (i.e. temporary foreign worker) and have a valid work permit (not implied status or restoration status) for an eligible occupation based on either a positive Labour Market Impact Assessment (LMIA), or a LMIA exemption for workers covered under international trade agreements, workers transferred within a company, or people taking part in International Experience Canada.

Further, AINP will implement language tests as mandatory with a certain CBL level as well as a required education level of high school diploma proven by an ECA report. The applicants who earned a Canadian degree, diploma or certificate from a recognized Canadian post-secondary, technical college or secondary institution, or possess work experience that qualifies them for the AINP in a compulsory or optional trade and have a valid Alberta Qualification Certificate or trade certificate that is recognized by Alberta Apprenticeship and Industry Training will not be required to provide an ECA report.

Furthermore, in accordance with the qualifying work experience criteria, when submitting an application, the candidate should have been working full time in the same current occupation for a minimum of 12 months within the last 18 months; or should have gathered a minimum of 24 months of full-time work experience in their current occupation in Canada and/or abroad within the last 30 months. The latter can be a combination of experience gained in Alberta, in Canada (outside Alberta) and/or abroad.

The AINP will also implement income level requirements where an applicant will have to meet a minimum gross annual income level based on their family unit.

The AINP will impose a quota for the number of applications each year, and sub-quotas set based on sector or occupation.

The post Changes to the Alberta Provincial Nominee Program first appeared on Bellissimo Law Group.

Just announced by Human Resources and Skills Development Canada (HRSDC):

Effective April 25, 2012, HRSDC/Service Canada is implementing a new Accelerated Labour Market Opinion (A-LMO) Initiative. This new Initiative applies to employers hiring temporary foreign workers in higher skilled positions such as: management, professional and technical occupations.

The 2 main objectives of the new A-LMO Initiative are:

improving the integrity of the Temporary Foreign Worker Program and labour market outcomes;

responding to the employers’ need for more efficient and timely LMO processing.

To be eligible to participate in the A-LMO Initiative, employers must:

have been issued at least 1 positive LMO in the previous 2 years;

have a clean record of compliance with the Program within the last 2 years;

not have been the subject of an investigation, infraction or a serious complaint; and

not have any unresolved violations or contraventions under provincial laws governing employment and recruitment.

This new A-LMO Initiative introduces efficiency measures by reducing the amount of paper-burden on employers in the application process, and by introducing attestations for specific assessment criteria that can be reviewed through a subsequent compliance review. In addition to the attestation-based assessment, HRSDC/Service Canada will provide an A-LMO based on:

the genuineness of the job offer;

the wage offered to the temporary foreign worker;

whether the job offer is likely to fill a labour shortage.

If the employer is deemed eligible, HRSDC/Service Canada will issue an opinion, within 10 business days, based on the employer’s agreement to follow the necessary Program requirements and the A-LMO assessment criteria. In addition, employers ma

Please be advised that at the present time, the Initiative does not apply to the Seasonal Agricultural Worker Program, the Agricultural Stream and occupations in the film and entertainment sectors.
The Initiative is currently not implemented in the province of Quebec.
