It is very important to make a proper evaluation of each case on its own merits, whether the individual qualifies under any other program, for example under Federal Skilled Worker or Canadian Experience Class programs. We had a few cases when the applicant or /and his spouse did not qualify for any of these programs. We then started looking for provincial nominee programs, especially Ontario, as those individuals were working already in Ontario and many of their employers wanted to help. For the Ontario Employer Job Offer program, we were quite successful by using both streams, the International Student Stream with a job offer and the Foreign Worker stream with a job offer. Though obtaining the nomination via OINP or any other province takes longer than the above-mentioned programs, in the end it is a good solution for those who do not meet the requirements otherwise. The fees paid are also higher, as the applicants must pay both the provincial nominee fees and the federal permanent residence application fees, but the result is worth it.

One of the most common/popular streams is the Ontario’s Express Entry Human Capital Priorities Stream, which is designed for skilled workers who want to live and work permanently in Ontario.

Express Entry Human Capital Priorities Stream: Who Can Apply?

To be eligible to apply under Ontario’s Express Entry Human Capital Priorities Stream, the applicant must meet provincial and federal eligibility criteria. To qualify under this stream one must:

1. Have a valid profile in the Express Entry pool;
2. Qualify for either the Federal Skilled Worker Program (FSWP) or the Canadian Experience Class (CEC);
3. Indicate an interest in immigrating to either Ontario or “All Provinces and Territories” when you create a profile in Express Entry; AND
4. Have received a Notification of Interest from Ontario through your IRCC online account.

Ontario Express Entry Human Capital Priorities Stream Criteria:

To be eligible to apply, the applicant must meet the following provincial criteria:

1. Work Experience: A minimum of either:
   • one year work experience within the past five years according to the criteria under the Federal Skilled Workers Program;
   • one year work experience within the past three years according to the criteria under the Canadian Experience Class;
2. Education: Equivalent of a Canadian Bachelor’s degree or above;
3. Language: A minimum of Canadian Language Benchmark (CLB) 7 in English or in French;
4. Settlement Funds: A minimum level of savings or income to support you and your family members;
5. Intent: An intention to live in Ontario;
6. Legal Status in Canada (if applicable): Must have legal status in Canada (i.e., study permit, work permit, visitor record) if currently residing in Canada. (Note: Refugee claimants with a pending application to remain in Canada are not eligible to apply to OINP. Refugee claimants whose claim has been rejected, abandoned, or withdrawn must exit Canada prior to applying to OINP. Refugee claimants may only apply to OINP once they have left Canada);
7. Comprehensive Ranking System (CRS) Score: Must have obtained a minimum CRS score under the Express Entry system as determined by the director.

How Can I Apply?

Step 1: Create an online Express Entry profile;

Step 2: If OINP identifies you in the Express Entry pool, you will receive a Notification of Interest from Ontario through your IRCC online account. This notification will invite you to apply to OINP for nomination under the Human Capital Priorities Stream;

Step 3: After you receive a Notification of Interest from Ontario through your IRCC online account, you have 45 calendar days to apply to OINP under the Human Capital Priorities Stream. Please note that the application fee is $1,500, and is non-refundable;

Step 4: Accept nomination from Ontario and apply for permanent residence

• If your application is approved by Ontario, you will receive a letter from OINP through your IRCC online account notifying you of your nomination. You have 30 calendar days to accept the nomination from Ontario in the Express Entry system.
• A nomination from Ontario will give you an additional 600 points in the Comprehensive Ranking System (CRS) and you will receive an invitation to apply for permanent residence from IRCC.
• Once you receive an invitation to apply from IRCC, you have 90 calendar days to submit your application for permanent residence to IRCC.

When the program opens, the first step is to secure your spot by registering and creating a profile in OINP e-Filing Portal, after which you will have 14 calendar days to submit your application. The application fee is $1,500.

To be eligible to apply, you must meet the following criteria:

• Completed the requirements necessary to obtain a Master’s degree that is at least one academic year in length or PhD degree that is at least two years in length if pursued on a full-time basis and from an eligible Ontario institution;
• Meet a minimum of Canadian Language Benchmark of Level 7 or above in English or French;
• Demonstrate that you have resided in Ontario for at least one year in the last two years before the application submission date, and intend to continue to reside in Ontario;
• Demonstrate that you have a minimum level of savings or income to support you and your family members;
• At the time of application must be residing in Ontario with legal status or residing outside of Canada. You will not qualify if you reside in Canada but outside of Ontario;
• You must apply within two years of completing the requirements necessary to obtain your Master’s degree.

Once the applicant receives nomination from Ontario, he/she must apply to IRCC for permanent residence within 6 months of being nominated by OINP and include copies of the Letter of Nomination and the OINP Confirmation of Nomination document. Note, however, that nomination by OINP does not guarantee that your application for permanent residence will be approved by IRCC.

The program assists successful nominees to gain permanent residence status in Canada.  Each year, the total number of nominations permitted by Ontario PNP is capped by Immigration, Refugees and Citizenship Canada (“IRCC”). Opportunities Ontario has now announced its quota for the 2018, a total of 6,600. This is an increase of 600 nominations from the 2017 year.

Currently, the eligible categories under the Ontario PNP which are open are:

• Employer Job Offer: Foreign Worker Stream
• Employer Job Offer: International Student Stream
• Employer Job Offer: In-Demand Skills Stream
• Ontario’s Express Entry Human Capital Priorities Stream
• Ontario’s Express Entry French-Speaking Skilled Worker Stream
• Ontario’s Express Entry Skilled Trades Stream
• Corporate Stream
• Entrepreneur Stream

Important to note is that the popular Masters Graduate and PhD Graduate Streams has not yet re-opened. Any updates regarding this program will be announced on OINP’s updates page.

Express Entry – Human Capital Priorities Notification of Interest

The OINP has also commenced issuing Notification of Interests (NOIs) under their Human Capital Priorities stream. Interestingly, differing from the selection methodology from last year, they are now posting the number of NOIs issued along with the score range selected.

The first draw for the 2018 year was posted this week on OINP’s website and consisted of:

NOIs issued: 340
CRS score range: 440 to 446

On June 28, 2017 OINP announced that it would issue targeted Notifications of Interest (NOIs) to candidates who qualify for Ontario’s Express Entry Human Capital Priorities (HCP) Stream and who have work experience in the Information and Communications Technology (ICT) sector. OINP posted a list of occupations for which OINP lowered the required minimum Comprehensive Ranking System (CRS) score below 400; however, candidates will still need to meet all other HCP stream eligibility, such as work experience, education, language, settlement funds, and intention to reside in Ontario.

OINP encouraged prospective candidates to create a new profile in the Express Entry system to make it easier for Ontario to identify their profile.

On January 23, 2017 a new online application process under the French-Speaking Skilled Worker Stream was launched. The OINP indicates that online application systems will help to improve processing times for applicants as well as enhance client service.

If an applicant received a Notification of Interest (NOI) from Ontario before January 23, 2017, the applicant may submit a paper application to the OINP by mail. All applications after launching the online system should be submitted online.

We will continue to monitor the OINP website for updates and hope that remaining temporarily closed programs will be re-opened in the near future.

The program assists successful nominees to gain permanent residence status in Canada. Each year, the total number of nominations permitted by Ontario PNP is capped by Citizenship and Immigration Canada (“CIC”).

As of 16 November 2015, OINP has announced they have exhausted its “base stream” allocation for 2015 of 2,500. OINP will however continue to accept nominee application(s) under the Foreign Worker and International Student with a Job Offer streams where their respective employers have already received pre-screen approval.

New Employer pre-screen applications or applications under the Master’s and PhD streams will not be accepted for the remainder of this year. The program will only welcome new applications under these streams commencing on January 1, 2016.

Nominee applications that have not been finalized in the 2015 will automatically be placed in priority for finalization in 2016.

It is important to note that this pause does not affect the OINP Express Entry stream. This category remains open and applications are still being accepted under this sub-category. Currently eligible categories under the OINP Express Entry categories are:

• Ontario Express Entry: Human Capital Priorities Stream
• Ontario Express Entry: French-Speaking Skilled Worker Stream
