IRCC Updates Guidance on Temporary Resident Permit Holders Applying for Permanent Residence
IRCC has updated its guidance on how Temporary Resident Permit (TRP) holders may apply for permanent residence under the permit holder class.
To qualify, applicants must generally hold a valid TRP throughout processing and have continuously resided in Canada as a permit holder for the required period. The required period is 3 years for certain health-related inadmissibility grounds and 5 years for most other eligible grounds.
IRCC has also clarified that TRPs issued because a foreign national does not meet certain requirements of the Immigration and Refugee Protection Act, such as lacking a valid passport or temporary resident visa, do not qualify under the permit holder class.
Applicants should also be aware that leaving Canada, allowing a TRP to expire before obtaining a subsequent permit, or becoming inadmissible on a new ground may interrupt the required period of continuous residence.
Each family member must meet the requirements independently and submit their own application.
For more information or to determine whether you may qualify, legal advice should be obtained based on your individual circumstances.
